Cybereco is a non-profit organization whose mission is to develop the cyberresilience of organizations and individuals in addition to developing cyber talent.

As part of this mission, Cybereco operates the website “https://Cybereco.ca/” hereinafter referred to as the “Website”. This Website is a reference center in terms of cybersecurity. The purpose of the Website is to help users find multiple information related to cybersecurity and Cybereco activities / news.

The use of the Website is governed by the “Terms and Conditions of Use” reproduced below which constitute a contract between the user and Cybereco.

Website terms of use

By accessing and using the Website, you acknowledge having read and understood the “Terms and Conditions of Use” below, agree to be bound by them and agree to abide by them for as long as you are on the Website. These set out the terms and conditions under which you can visit and use the Website and its content. You also furthermore agree to be bound by any modification made to the said “Terms and Conditions of Use”, which come into force immediately after the download of the terms of use on the Website. Cybereco is aware of the issues raised regarding the circulation of personal information on the Internet and wishes to collaborate with you to ensure the respect and protection of your personal information and your privacy in accordance with the applicable legislation. The present policy is intended to explain our practices regarding the information we collect when you visit our Website.

According to the Act respecting the protection of personal information in the private sector, personal information is considered to be “any information which relates to a natural person and allows that person to be identified”.

Cybereco does not collect, use or disclose personal information without your consent and only for determined purposes. This consent can be implied or explicit, depending on the situation.

You may withhold or withdraw your consent to the collection, use and disclosure of personal information about you provided there is no legal or contractual reason that prevents you from doing so. However, and depending on the circumstances, withdrawing your consent may prevent us from continuing to provide you with the products and services you have requested, or from adequately assessing and processing your requests.

Collection of Personal Information

Personal information is collected through forms to be completed directly by the person concerned.

The personal information that may in particular be collected on the Website is as follows:

  • Name of the organization;
  • Address for correspondence;
  • Phone number;
  • Fax number.

Any information you submit about yourself must be accurate. You are solely responsible for the format, content and accuracy of any information or element you provide on the Website.

The personal information requested is limited to what is necessary according to the circumstances and to fulfill the purposes for which it is requested.

Use and Disclosure of Personal Information

Personal information collected will only be used for the purposes mentioned during collection.

Cybereco will not communicate to third parties any nominative list containing personal information without the persons concerned having had the opportunity to refuse that this information be used by a third party for commercial prospecting or philanthropic purposes.

Employees and agents of the Cybereco Website operator, Mondata, who are entitled to know your personal information will have access to it only on the condition that the disclosure of this information is necessary for the performance of their duties or the execution of their mandate. We also use the following providers who will hold some of your information: Eventbrite (event registration platform), Mailchimp (marketing services platform used to send emails) and Swapcard (virtual events platform)

Retention Period of the Information

The person in charge of the processing of personal information will keep in its computer systems of the Website and under reasonable conditions of security all the personal information collected only during the time necessary for the achievement of the purposes for which it was collected, in particular the time to comply with our legal obligations and to perform our contracts with our customers, members and partners.

Canada’s Anti-Spam Legislation

Before sending you any commercial electronic messages by email, Cybereco ensures, when required, that it has obtained your consent in accordance with the terms set out in Canada’s Anti-Spam Legislation. Your consent will also be obtained before our business partners can themselves send you by email such commercial electronic messages.

Cybereco reserves the right to propose and offer you services and products from third parties according to the preferences you have indicated when registering or subsequently if you have agreed to receive offers from third parties.

Cybereco undertakes to take the necessary measures with its business partners to ensure that any customer who has at one time or another served notice of its desire for exclusion be removed from their sending list of commercial electronic messages.

Internet Data Collection (cookies)

For statistical purposes and with a view to improving services, Cybereco may also automatically collect general anonymous information relating to your use of the Website, such as the date and time of your visit to the Website and the pages of the Website that you are viewing. The servers may also collect information about the type of browser you are using, as well as your computer’s IP address and the name of your Internet service provider.

Cybereco uses the technology of cookies. You will find attached the list of cookies used by the Website and the type of information collected on behalf of Cybereco.

Right of Access, Rectification and Removal of Rersonal Information

The personal data of site users is hosted by Mondata in the AWS Canadian Cloud environment.

At the request of any user, Cybereco must confirm the existence of a file concerning him and provide him, if applicable, all the personal information concerning him contained in this file.

Any person may have inaccurate, incomplete or equivocal information corrected in a file concerning him; it can also delete outdated information or information not justified by the subject of the file, or make comments in writing and add them to its file.

The users also have the right, at any time, to request and obtain the removal of the information they have transmitted.

Intellectual property

Respect for intellectual property is essential for Cybereco. All content created, developed, eleborated, displayed or generated by Cybereco on the website (texts, illustrations, images, logos, codes, registered or unregistered trademarks and URLs) belong to Cybereco or are under license of third parties. These contents are protected by various laws, in particular those concerning copyright.

Any reproduction, publication, translation, distribution, download, posting, transmission, public performance or other infringement of the content included in the Website, in part or in whole, other than what is specifically provided and authorized therein, is strictly prohibited. Any unauthorized use of said content exposes the offender to civil liability and criminal prosecution under common legislation or legislation affecting intellectual property.

No license or right of use is conferred to you or can be inferred from your access of the Website. Thus, nothing on the Website should be interpreted in such a way as to allow, directly or indirectly, the use of the contents of the Website without the prior written permission of the owner.

These “Terms and Conditions of Use” are put in place to protect users as well as to maintain the quality of services. Cybereco reserves the right to suspend or delete, at any time, a registration to the Website, without warning, as soon as the user violates any of the clauses of this contract.

Limitation of liability

Cybereco offers its services as is, without any warranty of any kind whatsoever, nor any express or implied liability. Cybereco will not be held responsible for incidents or consequences of any damage suffered, whether direct or indirect, resulting from the use of its services. All information included on the Website is offered as is without any guarantee as to the accuracy or reliability of the content.

Although Cybereco makes the best efforts to ensure the security of the Website and to maintain its integrity, it does not guarantee or make any representation as to the quality, validity or accuracy of the information which may be found there.

More particularly and without restricting the generality of the foregoing, Cybereco cannot control access to the elements and information found on the Website, nor their use, by any person other than an authorized administrator of the Website.

Cybereco does not guarantee continuous, uninterrupted and secure access to its services. The Website may experience occasional breakdowns and certain programming errors may be caused by updates or by events beyond the control of the administrators.

Cybereco declines all responsibility for any error that may be found on the Website. Cybereco, its partners, directors, officers, employees, representatives and agents can in no way be held liable for any damage directly or indirectly related to the use of the Website, whatever it may be.

Under no circumstances can Cybereco, nor any of its partners, directors, officers, employees, representatives and agents, be held responsible for acts of computer hacking or be blamed for any damage or loss that this could cause to a user of the Website.

Indemnification

The user undertakes to take up the interest and defend Cybereco, its partners, directors, officers, employees, representatives and agents, in any lawsuit or claim brought against them following a violation of this contract made by you or any person having access to your account, and to hold them harmless from any judgment or decision that may be pronounced against them, in capital, interest and costs. Consequently, the user agrees to pay all costs and fees paid, it being understood that Cybereco, its partners, directors, officers, employees, representatives and agents may then be represented by the attorney of their choice.

Termination of services

Cybereco may terminate all the services offered on the Website at any time and at its sole discretion without compensation of any kind.

At the termination of the services, all your information, including that of the profile will be deleted from the database of the Website. However, data may remain for a certain period due to the processing time required for their deletion.

Applicable law

This contract is governed by the laws applicable in the province of Quebec. You acknowledge by this contract that any dispute related to the use of the services and the website will be submitted to the competent court of the judicial district of Montreal, province of Quebec, to the exclusion of any other court.
